2. SCOPE AND OUR ROLE

Our privacy role depends on the circumstances.

When Hero Magnet acts as a controller or business

We generally determine the purposes and means of processing when we process information relating to:

visitors to HeroMagnet.com;

people who contact Hero Magnet directly;

Hero Magnet prospects and leads;

our business clients;

When Hero Magnet acts for a client

Clients may use Hero Magnet to operate AI agents, CRM systems, chatbots, telephone systems, marketing automations, forms, appointment-setting systems, and related technology for their customers and prospects.

When we process personal information solely according to a client's instructions, the client generally determines why and how that information is processed. Hero Magnet may therefore act as a “processor,” “service provider,” or “contractor.”

If you are interacting with one of our client's businesses, that client's privacy policy may primarily govern the processing of your information. Requests concerning information controlled by that client may need to be directed to the client.

We may assist clients in responding to privacy requests as required by our agreements and applicable law.

We may combine this information with information obtained directly from you.

Where applicable law requires us to provide additional notice when personal information is obtained indirectly, we will provide that notice within the required period or at the time of our first communication.

6. SENSITIVE PERSONAL INFORMATION

Depending on the services being provided and the information submitted by users or clients, our systems may process information considered sensitive under applicable privacy laws.

This can include:

account credentials;

financial information;

precise geolocation;

contents of private communications;

information concerning health that appears in conversations or submitted materials;

biometric information;

voiceprints used for identification;

authentication information; and

other sensitive information voluntarily submitted through free-form communications or files.

We ask users not to provide highly sensitive personal information unless it is necessary for a legitimate purpose and appropriate for the service being provided.

Where applicable law requires consent or another special legal basis before processing sensitive information, we will seek the required authorization.

7. BIOMETRIC INFORMATION AND VOICEPRINTS

Certain Hero Magnet or client systems may include biometric functionality, such as voice recognition or voiceprints used to recognize or authenticate an individual.

Ordinary audio recording, speech-to-text transcription, or AI analysis of a conversation does not necessarily constitute biometric identification. Where we intentionally create or use a biometric identifier for identification purposes, additional requirements may apply.

Where required by applicable law, we will:

provide a separate biometric-data notice;

explain the purpose of the biometric collection;

disclose the expected retention period;

obtain legally required consent before collecting or enrolling biometric identifiers;

restrict disclosure of biometric information;

protect biometric information using reasonable safeguards; and

delete or destroy biometric identifiers according to applicable retention requirements.

Hero Magnet does not sell biometric identifiers for monetary consideration.

Biometric information will not be used for unrelated general-purpose AI training unless the use has been separately disclosed, is legally permitted, and any consent required by applicable law has been obtained.

8. AI VOICE AGENTS, TELEPHONE CALLS, AND RECORDINGS

Hero Magnet provides and operates AI-powered voice technologies.

Depending on the service, you may communicate with an automated or AI-generated voice rather than a human representative.

AI agents may operate for Hero Magnet or on behalf of one of our business clients and may identify themselves using Hero Magnet's name, the client's business name, or both, depending on the context.

AI disclosure

Where required by law or appropriate to the interaction, callers will be informed that they are interacting with an automated or AI-powered system.

Call recordings and transcripts

Telephone calls may be:

recorded;

monitored;

transcribed;

summarized;

analyzed by AI;

reviewed by authorized personnel; and

associated with a CRM record.

We provide notice of call recording or transcription where required by applicable law.

Where affirmative consent is legally required before recording a confidential communication, we will obtain the required consent.

AI analysis

AI systems may analyze conversations for purposes such as:

determining intent;

identifying questions or objections;

measuring sentiment;

evaluating lead quality;

determining appointment readiness;

improving responses;

assisting sales or support personnel;

quality assurance;

training;

fraud and abuse detection; and

improving our services.

AI-generated and cloned voices

Our systems may use synthetic or AI-generated voices.

Where a voice is based on or designed to replicate an identifiable person's voice, we require appropriate authorization or other lawful authority to use that voice and will comply with applicable disclosure and consent requirements.

11. AI TRAINING, FINE-TUNING, AND MODEL IMPROVEMENT

Because Hero Magnet provides AI-powered services, certain information may be used to develop, evaluate, improve, train, or fine-tune artificial intelligence and machine-learning systems.

Subject to applicable law, contractual restrictions, required consent, and the context in which the information was collected, this may include:

Third-party AI providers

Personal information may also be transmitted to third-party AI providers that process information to provide AI functionality.

Depending on the provider, service plan, settings, contractual terms, and applicable law, a provider may use submitted information to operate, secure, evaluate, improve, develop, or train its technologies, including potentially general-purpose AI models.

Where applicable law or our contractual obligations prohibit such use, we will restrict it accordingly or use settings and services designed to prevent the prohibited use.

Where consent is legally required for a particular training or model-development use, we will obtain consent before relying on that processing.

Client-controlled information

When Hero Magnet processes information solely as a client's processor or service provider, we will not use that information for an unrelated independent purpose—including Hero Magnet's own marketing or unrelated AI training—unless:

our agreement with the client permits the use;

Hero Magnet has an independent lawful basis for the use;

required privacy notice has been provided; and

any legally required consent or opt-out rights have been honored.

De-identified and aggregated information

We may create aggregated, statistical, or de-identified information and use it for analytics, research, benchmarking, product development, security, and service improvement.

Where information is treated as de-identified under applicable law, we will take reasonable measures intended to maintain it in de-identified form and will not attempt to re-identify it except where legally permitted.

12. OUR LEGAL BASES FOR PROCESSING

Where the GDPR, UK GDPR, or another law requiring a legal basis applies, our legal bases may include:

Contract

We may process information when necessary to:

enter into a contract;

provide requested services;

manage our relationship with a client;

process payments; or

perform contractual obligations.

Consent

We may rely on consent for activities such as:

certain marketing communications;

non-essential cookies;

certain advertising technologies;

call recording where consent is required;

certain automated telephone communications;

biometric processing;

certain AI-training activities;

processing certain sensitive personal information; and

other activities where applicable law requires consent.

Where processing is based on consent, you may withdraw consent as permitted by law.

Legitimate interests

Where permitted, we may process information based on legitimate business interests such as:

operating and improving our business;

responding to inquiries;

business-to-business marketing;

maintaining customer relationships;

preventing fraud;

maintaining security;

conducting analytics;

improving AI systems;

measuring service performance; and

protecting our rights.

Where required, we assess whether those interests are overridden by the rights and interests of affected individuals.

Legal obligations

We may process information when necessary to comply with:

tax requirements;

accounting requirements;

court orders;

lawful governmental requests;

recordkeeping obligations; and

other applicable laws.

13. MARKETING COMMUNICATIONS

We may communicate through:

email;

SMS/text messaging;

telephone;

AI-generated or artificial voice;

WhatsApp;

Facebook;

Instagram; and

other communication channels.

We will seek consent before sending communications where applicable law requires it.

Consent to receive marketing communications is not a condition of purchasing goods or services where applicable law prohibits such a condition.

You may opt out of marketing communications at any time.

For promotional email, use the unsubscribe link contained in the message.

For applicable SMS communications, you may reply STOP or use another opt-out mechanism provided in the message.

For telephone marketing, you may tell the caller or AI agent that you do not wish to receive further marketing calls.

We may retain limited suppression-list information after an opt-out so that we can honor your preference.

Transactional, administrative, security, or service-related communications may continue where necessary even after you opt out of promotional marketing.

14. COOKIES, PIXELS, AND TRACKING TECHNOLOGIES

Hero Magnet and third parties may use:

cookies;

pixels;

tags;

web beacons;

SDKs;

local storage;

tracking URLs;

analytics technologies;

session-replay technologies;

heatmaps; and

similar technologies.

These technologies may be used for:

website functionality;

security;

remembering preferences;

analytics;

measuring traffic;

advertising;

attribution;

conversion measurement;

retargeting;

audience creation; and

personalization.

Advertising and analytics

Third-party advertising and analytics providers may collect information about your activities on our website and, depending on their technology, across other websites or services.

These providers may include platforms operated by companies such as Google, Meta, TikTok, LinkedIn, Microsoft, and similar advertising or analytics providers.

Cookie controls

Where required by applicable law, non-essential cookies and similar technologies will be activated only after required consent has been obtained.

You may also control cookies using browser settings and available cookie-preference tools.

Blocking cookies may affect certain website functions.

15. DO NOT TRACK AND GLOBAL PRIVACY CONTROL

Some browsers transmit a legacy “Do Not Track” or “DNT” signal.

Because there is no universally adopted standard governing how websites must respond to legacy DNT signals, our systems may not respond to every DNT signal.

This is different from legally recognized opt-out preference signals.

Where applicable privacy law requires us to recognize an opt-out preference signal such as Global Privacy Control (GPC), we will treat a valid signal as a request to opt out of the sale or sharing of personal information associated with that browser or device, as required by law.

We may disclose personal information to companies that help us provide our services.

These may include:

CRM and automation platforms

establish or defend legal claims.

17. SALE AND SHARING OF PERSONAL INFORMATION

Hero Magnet does not sell personal information to data brokers for monetary consideration as part of our ordinary business model.

However, privacy laws such as the California Consumer Privacy Act may define “sale” or “sharing” more broadly than an exchange of information for money.

For example, our use of advertising cookies, pixels, Custom Audiences, retargeting, or cross-context behavioral advertising may constitute “sharing” under California law.

Categories that could be shared for these purposes include:

identifiers;

device identifiers;

internet or electronic activity;

approximate geolocation;

advertising information;

commercial information; and

inferences concerning interests.

Where applicable law provides a right to opt out, you may exercise that right through our privacy-choice mechanism or by contacting us.

We do not knowingly sell or share personal information relating to individuals under 16 without legally required authorization.

18. CLIENT INFORMATION AND HERO MAGNET'S OWN MARKETING

Information received from a client for the purpose of providing services to that client will ordinarily be used for those contracted services.

Hero Magnet will not automatically treat a client's customer database as Hero Magnet's own marketing database.

If Hero Magnet wishes to use an individual's information obtained through a client for Hero Magnet's independent marketing purposes, we will do so only where the use is permitted by applicable law, consistent with our contractual commitments, supported by an appropriate legal basis, and accompanied by any required privacy notice, consent, or opt-out opportunity.

Information provided by one client will not be used to provide another client's marketing or advertising services in a manner prohibited by applicable law or our contractual commitments.

19. DATA RETENTION

We retain personal information only for as long as reasonably necessary and proportionate to accomplish the purposes for which it was collected, satisfy contractual requirements, comply with law, resolve disputes, maintain security, and enforce agreements.

Unless a different period is required by a client contract, law, consent, or operational need, our intended retention guidelines are generally:

Website inquiries and prospective leads: generally up to 24 months after the last meaningful interaction, unless an ongoing relationship or valid marketing basis exists.

Hero Magnet CRM records: generally for the duration of the active relationship and up to 3 years afterward where reasonably necessary for business, support, dispute, or compliance purposes.

Client-controlled CRM information: generally for the duration of our services and then deleted, returned, or de-identified according to the client's instructions and applicable contract, typically within 90 days after termination unless a longer period is required.

Call recordings: generally up to 12 months, unless a longer period is reasonably necessary for an active client service, training project, quality assurance, dispute, consented purpose, or legal requirement.

Call transcripts and chatbot conversations: generally up to 24 months, subject to client instructions and legitimate operational or training needs.

SMS and email communications: generally up to 3 years after the relevant relationship or communication, unless needed longer for a legitimate business or legal purpose.

Uploaded documents and media: generally for the duration necessary to provide the requested service and up to 90 days after the associated service ends, unless otherwise agreed.

Analytics and online identifiers: according to the configuration and retention limits of the applicable analytics or advertising provider, generally not longer than reasonably necessary for analytics and advertising purposes.

Billing, tax, transaction, and contract records: generally up to 7 years or another period required by applicable tax, accounting, or legal requirements.

Marketing opt-out records: may be retained for as long as reasonably necessary to ensure that an opt-out request continues to be honored.

AI training and fine-tuning data: retained only while reasonably necessary for the applicable development, evaluation, training, or model-management purpose and subject to applicable consent, contractual restrictions, deletion rights, and legal requirements.

We may retain information longer where necessary for legal claims, fraud prevention, security investigations, regulatory requirements, litigation holds, or other lawful purposes.

De-identified or aggregated information may be retained for longer periods where permitted by law.

20. DATA SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

Depending on the system and provider, safeguards may include:

HTTPS/TLS encryption in transit;

encryption at rest where available;

multi-factor authentication;

access controls;

password protections;

restrictions on employee and contractor access;

role-based permissions;

logging and monitoring;

backups;

confidentiality obligations;

vendor security controls; and

incident-response procedures.

No transmission method or storage system can be guaranteed to be completely secure.

If we discover a security incident involving personal information, we will investigate and provide notifications where required by applicable law.

21. INTERNATIONAL DATA TRANSFERS

Hero Magnet is based in the United States and may work with customers, clients, service providers, and individuals worldwide.

Personal information may therefore be transferred to, stored in, or processed in the United States or other countries that may have data-protection laws different from those in your country.

Where applicable law requires safeguards for international transfers, we may use mechanisms such as:

adequacy decisions;

the European Commission's Standard Contractual Clauses;

the UK International Data Transfer Agreement or UK Addendum;

contractual safeguards;

legally recognized certification mechanisms; or

another valid transfer mechanism.

We also take into account appropriate technical and organizational safeguards where required.

22. PRIVACY RIGHTS

These rights are subject to applicable legal limitations and exceptions.

We may need to verify your identity before completing certain requests.

Where permitted by law, an authorized agent may submit a request on your behalf. We may require evidence that the agent is authorized to act for you.

We will not unlawfully discriminate against you for exercising applicable privacy rights.

23. CALIFORNIA PRIVACY NOTICE

This section provides additional information for California residents.

It is intended to provide CCPA-style transparency regardless of whether Hero Magnet currently meets every statutory threshold for classification as a “business” under the California Consumer Privacy Act.

Where a particular CCPA obligation applies only to covered businesses, the corresponding right or obligation applies to Hero Magnet to the extent required by law.

Hero Magnet's services are intended for businesses and adults age 18 and older.

Our services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without legally required authorization.
